NexGenPCs Terms of Service

Welcome to NexGenPCs. These Terms of Service ("Terms") govern your use of the NexGenPCs website, services, and purchase of products from NexGenPCs.

By accessing our website, placing an order, or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products or services.

1. About NexGenPCs

NexGenPCs provides custom-built computers, pre-built computers, computer components, repairs, upgrades, and related technology services.

Because many of our products and services are customized to individual customers, additional terms may apply depending on the product or service purchased.

2. Orders & Custom Builds

When placing an order with NexGenPCs, you agree that the information provided during checkout is accurate and complete.

Custom-built PCs are assembled according to the specifications selected or approved by the customer.

Once a custom PC order has entered the build or procurement process, changes to components or specifications may not be possible.

NexGenPCs reserves the right to contact the customer regarding component availability, compatibility, pricing changes, or other issues that may affect an order.

If a selected component becomes unavailable, NexGenPCs may contact the customer to discuss an appropriate replacement or alternative.

3. Pricing & Payments

All prices displayed on the NexGenPCs website are subject to change without notice before an order is placed.

Once an order has been successfully placed and payment has been accepted, NexGenPCs will make reasonable efforts to fulfill the order at the purchased price.

NexGenPCs reserves the right to cancel an order and issue a refund if a pricing error, product availability issue, payment issue, or other significant error occurred.

Customers are responsible for providing accurate billing and payment information.

4. Customization

Customers are responsible for reviewing and approving their selected components and specifications before purchasing a custom PC.

NexGenPCs will make reasonable efforts to ensure that selected components are compatible and function as intended. However, certain software, peripherals, games, applications, or third-party services may have their own requirements or limitations.

Performance can vary depending on software, settings, drivers, games, applications, and other factors outside of NexGenPCs' control.

5. Processing & Delivery

All computer orders, including custom builds, may take up to 4–6 weeks to be processed, assembled, tested, and prepared for delivery or shipment.

Any date displayed on the NexGenPCs website is an estimate and is not a guaranteed completion or delivery date.

If an order is expected to take longer than the estimated timeframe, NexGenPCs will contact the customer with an updated estimated completion or delivery date.

Shipping and delivery are subject to the NexGenPCs Shipping & Delivery Policy.

6. Returns, Refunds & Repairs

Custom-built PCs are generally final sale and are not eligible for returns or refunds due to a change of mind, buyer's remorse, or other reasons unrelated to a defect or problem with the product.

If a PC is damaged, defective, or experiences a qualifying hardware or technical issue, NexGenPCs may provide troubleshooting, repair, component replacement, or, in certain circumstances, a partial or full refund.

Any approved repair, replacement, or refund will be determined on a case-by-case basis.

7. Warranty & Service

NexGenPCs may provide repair or warranty-related services depending on the product or service purchased.

Manufacturer warranties may also apply to individual components and are subject to the manufacturer's terms and conditions.

NexGenPCs is not responsible for warranty coverage provided directly by a component manufacturer.

Customer-caused damage, unauthorized modifications, improper installation, misuse, liquid damage, physical damage, or other damage outside the applicable coverage may not qualify for free service.

8. Repairs & Upgrades

Customers requesting repairs, upgrades, modifications, or other services are responsible for providing accurate information about their device and its condition.

NexGenPCs may determine that additional work or replacement components are necessary to complete a requested service.

Customers will be informed of significant additional costs when reasonably possible before the additional work is performed.

NexGenPCs is not responsible for pre-existing problems that were not caused by NexGenPCs.

9. Customer Responsibilities

Customers agree to:

• Provide accurate contact, billing, and shipping information.

• Review their order before completing their purchase.

• Use purchased products appropriately.

• Follow applicable safety instructions and manufacturer recommendations.

• Not intentionally damage, misuse, or modify products in a manner that could cause damage.

• Provide reasonable access to information needed to troubleshoot or service a device.

10. Website Use

The NexGenPCs website and its content are provided for informational and commercial purposes.

Customers agree not to:

• Attempt to interfere with or disrupt the website.

• Attempt to gain unauthorized access to NexGenPCs systems.

• Use the website for fraudulent or unlawful purposes.

• Copy, reproduce, or redistribute website content without permission.

• Use automated systems to improperly access or collect website data.

NexGenPCs reserves the right to restrict or terminate access to the website if these Terms are violated.

11. Intellectual Property

The NexGenPCs name, logo, branding, website content, graphics, photographs, written materials, and other original content are the property of NexGenPCs or their respective owners and may not be reproduced, copied, modified, or distributed without permission.

Product names, trademarks, logos, and other intellectual property belonging to third-party manufacturers remain the property of their respective owners.

12. Third-Party Products & Services

NexGenPCs may sell or install products manufactured by third parties.

NexGenPCs does not control the policies, warranties, software, services, or availability of third-party manufacturers and providers.

Third-party products and services may be subject to their own terms, warranties, licenses, and policies.

13. Limitation of Liability

To the maximum extent permitted by applicable law, NexGenPCs will not be responsible for indirect, incidental, consequential, or special damages arising from the use of our products or services.

This may include, but is not limited to, loss of data, loss of profits, business interruption, or loss of access to third-party services.

Customers are responsible for maintaining appropriate backups of important data.

Nothing in these Terms is intended to exclude or limit any rights or protections that cannot legally be excluded or limited under applicable law.

14. Data & Customer Information

NexGenPCs may collect and use customer information necessary to process orders, provide services, communicate with customers, arrange shipping or delivery, and provide customer support.

Customer information will be handled in accordance with the NexGenPCs Privacy Policy.

Customers are responsible for removing sensitive or personal information from devices before submitting them for repair when reasonably possible.

15. Fraud & Suspicious Transactions

NexGenPCs reserves the right to review, hold, or cancel orders that appear fraudulent, unauthorized, or otherwise suspicious.

Additional verification may be requested before an order is processed.

If an order is canceled for security or payment reasons, any eligible refund will generally be returned to the original payment method.

16. Changes to These Terms

NexGenPCs reserves the right to modify or update these Terms of Service at any time.

Changes will become effective when posted on the NexGenPCs website unless otherwise stated.

The Terms applicable to an order will generally be those in effect at the time the order was placed.

17. Governing Law

These Terms will be governed by applicable laws of the State of Maryland, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

These Terms, together with any applicable NexGenPCs policies referenced within them, constitute the general agreement between the customer and NexGenPCs regarding the use of our website and purchase of our products and services.
